With regard to the transfer of prison officer Mr Paul Robb from Geraldton to Roebourne, I ask - (1) Has an independent review of his case been carried out? (2) If yes, will the minister table the review? (3) If not, why not? Hon PETER FOSS

AnswerView source ↗

(1) A breach of the transfer standard was lodged by Mr Robb. However, this claim could not be examined under the standard, as it was deemed a disciplinary matter. Such matters cannot be examined under the Public Sector Standards (Review Procedures) Regulations 1995. An alleged breach of the discipline standard can be dealt with only by the dispute resolution process specified in the award or the enterprise or workplace agreement applicable to prison officers. (2) No. (3) The regulations provide for review reports to be provided to the relevant employing authority. A copy is provided to the Commissioner for Public Sector Standards for monitoring purposes. The commissioner includes the outcome of reviews in his annual compliance report to Parliament.
