Community sector organisations are able to provide out of home care services under section 79(2)(a)(ii) of the
Children and Community Services Act 2004
, which enables the Chief Executive Officer of the Department for Child Protection and Family Support to make an arrangement for the placement of a child "with a person who has entered into an agreement under section 15(1) for the provision of placement services."
