I refer to the
Sunday Times
report on 17 October 2010 concerning payments made to individuals who were victims of police misconduct and to comments attributed to the Minister in that article where the Minister stated that there was a need to revisit and review the guidelines for misconduct and that ongoing discussions with the Commissioner regarding the review were taking place, and I ask:
(a) was the Minister required to sign off on the payments and settlements before they were made; and
(i) if not, was the Minister briefed before, or after the payments occurred;
(b) why is it that the Minister considers a review of misconduct guidelines is necessary; and
(c) what actions does the Minister intend to take to ensure this review occurs?

(a) No, the Minister is not required to sign off on any settlements.
(i) No, there is no requirement for the Minister to be briefed before or after the payments are made.
(b-c) The Western Australia Police approach to the management of misconduct applies both the principles of the Fisher Model (Review of Professional Standards in the Australian Federal Police (2003) by the Hon. William Kenneth Fisher AO QC ) to modify behaviour and the discipline provisions of Section 23 of the
Police Act 1892
