With regard to the licensing approval to fill in the Bushplan wetland property of lot 1, Jackson Road, Oldbury - (1) Did this property have a full current planning approval that went through normal channels? (2) Was the appropriate development approval in place prior to this development commencing? Hon G.T. GIFFARD

I thank the member for some notice of this question. (1) The Shire of Serpentine-Jarrahdale received a development application for landfill operations on lots 1 and 12 and gave approval to lot 12 in June 1998.  An appeal to the then Minister for Planning was lodged with respect to filling of the southern portion of lot 1.  The minister upheld the appeal and gave approval for landfill operations on both lots 1 and 12 in April 1999.  The previous minister’s decision overrides any aspect of the shire’s approval. (2) In view of the time lapse since planning approval was given, the matter requires further investigation.  The minister has asked officers of the Department for Planning and Infrastructure to liaise with officers of the Shire of Serpentine-Jarrahdale and to advise her accordingly.
