JUSTICE CENTRE — SUPREME COURT INJUNCTION
797. Hon MICHAEL MISCHIN to the Minister for Disability
Services:
I refer to the Bennett Brook
Disability Justice Centre and the government's injunction restraining
the publication of information concerning it.
(1) Did the scheduled further
hearing take place on 9 August; and, if so, with what result?
(2) If the hearing did not take
place, why not; and, if it has been rescheduled, to what date?
(3) Has WorkSafe Western
Australia issued any improvement notices in respect of the centre since the
last election; and, if so, how many and on what dates?
(4) Will the minister table those
notices; and, if not, why not?
(5) Have WorkSafe's
requirements been met; and, if so, in what manner and when?

I thank the honourable member for
some notice of the question.
(1) The hearing took place on 9 August 2019 in the
Supreme Court before Hon Justice Tottle. At the request of a number of
defendants, the matter was adjourned to 30 August 2019 to allow the defendants
to consider their position and obtain legal advice. Justice Tottle
ordered that the injunction continue in the interim.
(2) Not applicable.
(3) Since 17
March 2017, a total of three improvement notices have been issued by WorkSafe
with respect to the centre. All were issued on 26 October 2018.
(4) I am seeking advice to confirm that there is no
reason not to table them, and will advise the house accordingly.
(5) All the
requirements of the improvement notices have been met. One was completed on 21
March 2019 and two were completed in May 2019. This has included amendments to
operational practice, including updated procedures, an increase in specialist
staff support, improved risk assessment processes, improved security
infrastructure and training for staff.
