(1) Section 40 (3) of the
Environment Protection Act 1986
provides for the Environmental Protection Authority (EPA) to determine “the form, content, timing and procedure of any environmental review required to be undertaken”. The Act does not constrain the EPA on what types of environmental impact assessments it can decide to carry out. However, the EPA has set out the normal levels of assessment it uses in its
Environmental Impact Assessments Administrative Procedures 1993 and Environmental Impact Assessments Administrative Procedures Amendment 1999.
I now table these Procedures on behalf of the Minister for the Environment and Heritage. See tabled paper.
(2) The Department of Environmental Protection (DEP) reports the total number of level of assessment decisions made each year, the number of these which are appealed, and the number of decisions for which appeals are upheld in its Annual Report.
I now table the information from the DEP’s 1999/2000 Annual Report which includes information for the last 10 years. The DEP’s 2000/2001 Annual Report will be published shortly. See tabled paper.
In addition, statistics on appeal decisions are available on the Appeal Convenor’s web site at
www.wa.gov.au/appeals
