TOUR LICENCE - DEPARTMENT OF CONSERVATION AND LAND MANAGEMENT’S STATUTORY OBLIGATIONS
(1) Is the minister aware that the Department of Conservation and Land Management failed to meet its statutory consultation obligations for “compatible operations” with respect to the granting of a tour licence to the City of Rockingham linked with the scuttling of the Saxon Ranger in Shoalwater Islands Marine Park? The Department of Conservation and Land Management (CALM) has met its statutory consultation obligations in relation to compatible operations in the granting of the tour licence for the Saxon Ranger. A compatible operations notice for Shoalwater Islands Marine Park was advertised in the Government Gazette on 23 April 1993.  This notice advertised CALM’s intent to licence tour operations in the marine park, in accordance with Section 33A of the Conservation and Land Management Act 1984 .  The issue of licences in accordance with the requirements of the CALM Act and the Conservation and Land Management Amendment Regulations 1993 was subsequently approved by the then Minister for the Environment on 15 July 1993, to allow commercial tourism operations in the marine park. Pursuant to the compatible operations notice in 1993 to allow commercial tourism operations in the marine park, the issue of this licence was approved by the Minister for the Environment on 20 May 2005 to allow dive wreck and dive operations for commercial recreation and tourism purposes, consistent with the purposes for which the marine park is managed. 2. Not applicable.
