I refer to a letter dated October 16 2003 signed by Mr Jim Limerick, Director General Department of Industry and Resources addressed to Mr S. Kean -
(1) Can the Minister state the specific dates of all the ‘previous investigations’ that the Director General is referring to?
(2) If no to (1), why not?
(3) Can the Minister state the specific names and positions of the departmental officers involved in these ‘previous investigations’?
(4) If no to (4), why not?
(5) Can the Minister state why the Department of Industry and Resources has not and will not in the first instance apologise to Mr S. Kean and others for providing incorrect and misleading information to the Minister and the Parliament and others in the last six years which has been extremely detrimental in many ways in terms of what the department refers to as ‘previous investigations’ and then offer redress that is procedurally sound?
(6) If no to (5), why not?
(7) Can the Minister explain why he has requested advice on only two issues and not all the issues raised in the letter dated August 29 2003?
(8) If no to (7), why not?
(9) Prior to completing any ‘departmental reports’ for the Minister will the Minister ask the Department of Industry and Resources to give natural justice and procedural fairness specifically by investigating all of Mr Kean’s evidence and concerns outlined in correspondence dated March 13 2003 and in a letter dated August 29 2003 addressed to the Minister where I understand he stated ‘I am respectfully requesting that your department not give approval for the increase to the Fimiston I dam wall height and an extra 30 per cent capacity or approval for something else without at least urgently investigating all of my concerns as were outlined in my correspondence dated March 13 2003 sent to the Director General Mr Jim Limerick’?
