(1) I refer the Minister to recent reports that a Glock Police issue pistol had recently accidentally or unintentionally discharged and ask will the Minister confirm that this discharge took place on 18 April 2003 and if not will the Minister advise the exact date of the discharge ?
(2) Will the Minister advise the following details about the discharge -
(a) the name of the Police officer that discharged the weapon;
(b) the rank of the Police Officer that discharged the weapon;
(c) the location that the discharge took place;
(d) the name and rank of the Police Officer that this incident was first reported to by the discharging officer;
(e) the date of this report;
(f) the names and ranks of all other Police Officers that this incident was subsequently reported to, the chain of reporting that followed and the dates of each of those reports;
(g) the name and rank of the most senior ranking officer that this incident was reported to prior to 22 May 2003 and the date that he first received this report and the name of the reporting officer;
(h) the names and ranks of any other Officers or individuals that were subsequently made aware of this incident by that senior ranking officer or any other officer concerned with the incident and the dates that these officers were first made aware of the incident;
(i) the name and rank of the individual that made the report mentioned in (g);
(j) had the magazine been removed from the weapon immediately prior to the discharge or was the magazine still attached to the gun;
(k) did the Officer in question think that the safety catch was on immediately prior to the discharge;
(l) was the Officer attempting to disengage the safety catch when the gun unintentionally fired;
(m) did the Police Officer in question intentionally pull the trigger;

The officer mistakenly thought the firearm was unloaded due to his own error and failed to comply with safety procedures. (2p) No (2q) At 1910 hrs on the evening of Friday 18 April 2003 First Class Constable Joseph Andrew Welsh 9865 was in the Armoury of the Perth Police Station to collect his firearm (a Glock pistol number WA0387PS) to proceed to patrol duties. First Class Constable Welsh removed the weapon from its secure location and placed it in his holster. He then loaded a magazine and put it in the butt of the weapon. He then filled a second magazine, which he placed in a pouch on his belt. At this point he removed his weapon from the holster and operated the slide mechanism causing the orange safety flag to be ejected from the breech and then let the mechanism slide forward. This action caused a round to be taken up from the magazine into the breach of the pistol contrary to approved training and procedures. First Class Constable Welsh then decided to do a serviceability check of his firearm, aimed the weapon at a 45-degree down angle in front of him and pulled the trigger. At this time a round fired from the weapon. (ii) Acting Inspector E. Gaspar, Internal Investigations Unit by telephone on 18 April 2003. (iii) Inspector R. Phipps Central Metropolitan District personally on 18 April 2003. Phipps (2j) The magazine had been removed (2k) The Glock pistol has no external safety catch, however, has three internal safety features including a trigger safety, a firing pin safety and a drop safety. The officer mistakenly thought the firearm was unloaded due to his own error and failed to comply with safety procedures. (2l) There is no external safety catch, refer to the answer at (2k) (2m) Yes (2n) To break the weapon down for a serviceability check. (2o) Action by way of an unfavourable report and retraining. (2p) No (2q) At 1910 hrs on the evening of Friday 18 April 2003 First Class Constable Joseph Andrew Welsh 9865 was in the Armoury of the Perth Police Station to collect his firearm (a Glock pistol number WA0387PS) to proceed to patrol duties. First Class Constable Welsh removed the weapon from its secure location and placed it in his holster. He then loaded a magazine and put it in the butt of the weapon. He then filled a second magazine, which he placed in a pouch on his belt. At this point he removed his weapon from the holster and operated the slide mechanism causing the orange safety flag to be ejected from the breech and then let the mechanism slide forward. This action caused a round to be taken up from the magazine into the breach of the pistol contrary to approved training and procedures. First Class Constable Welsh then decided to do a serviceability check of his firearm, aimed the weapon at a 45-degree down angle in front of him and pulled the trigger. At this time a round fired from the weapon.
