(b) have their positions been refilled, either in an acting or substantive way and if so, which positions have been filled;
(c) for that financial year, what was the total cost of these Management Initiated Retirements;
(d) what were the conditions of payment for the senior executives to receive the Management Initiated Retirements;
(e) will the Premier table a copy of the conditions;
(i) if not, why not;
(f) have any of those people who received Management Initiated Retirements since been re-engaged by the State Government in any capacity and received any further financial payments; and
(g) of those in (f), will the Premier provide details of the roles of those re-engaged, including their title, the nature of their work and the value of any payments made?

(d-e) A MIR package is offered on the following conditions. That the recipient shall:
(i) keep confidential all information related to the offer and acceptance of this package, including the circumstances, which this offer is made;
(ii) not use any of the information contained in this letter for a purpose other than the negotiation of this MIR package;
(iii) not subsequently engage in direct employment for the Government, nor shall you or any other corporation of which you are a Director supply any services to the Government for a period equivalent to the payment amount without the Premier's personal approval;
(iv) agree (subject to the provisions of any other Act) not to publicly express
any criticism in relation to matters relevant to the administration of the Agency (including the performance of the Minister responsible for that Agency) for which you worked immediately prior to taking the MIR package for a period until the writs are returned for the next general State election, or 12 months from the date of accepting the package, whichever is the greater; and
(v) nothing in condition (iv) obliges you to treat information as confidential where you are required to reveal the disclosed information pursuant to a provision of a statute or other law or where you are required to reveal or disclose information by a court or by virtue of an order given to you by the Government.

(g-h) Of the people who received a management initiated retirement in the 2006/2007 financial year, detailed in the table provided at answer (a-b), Mr Michael Jackson is known to have been re-engaged.
Mr Jackson was appointed as a Director of the Esperance Port Authority for the term 7 April 2007 until 31 December 2008. Directors of the Authority are entitled to a sitting fee, which increased from $11,000 to $16,500 per annum on 23 July 2007.
Mr Jackson was subsequently engaged as a consultant on a Ministerial Contract for Service to coordinate the State Government's response to lead and nickel contamination in Esperance. The contract commenced on 16 May 2007, currently proposed to conclude on 6 October 2007, although an extension is probable. Fees payable are at $140 per hour (excluding GST) to a maximum of $130,000 (excluding GST), although the maximum may increase if the consultancy is extended.
Mr Jackson has stood aside from his Director's role while undertaking the consultancy.
The terms of Mr Jackson's Management Initiated Retirement package expired on 7 July 2007.
