I refer to the "Enough is Enough" report into sexual harassment against women in the FIFO mining industry, and I ask: (a) Can the Minister confirm the newly renamed Department of Local Government, Industry Regulation and Safety (DLGIRS) has completed implementing an effective and comprehensive data management system capable of monitoring, recording, and reporting incidents of sexual harassment in the mining industry; (b) How many reports of sexual harassment and assault were recorded by the department in 2024-25? How does this compare to previous 2023-24; (c) How many non-disclosure agreements (NDA) or private settlements relating to sexual harassment or assault were reported to the department during the 2024-25 financial year; (d) What formal guidance, has the department issued to industry since the Minister’s directive to limit the use of NDAs in cases of sexual harassment or assault; (e) Can the Minister provide a status update on the formal information sharing arrangement between the department/WorkSafe WA and the WA Police Force; (f) Has the Minister completed a review of the WA regulatory framework to ensure that there is a consistent and comprehensive definition of ‘sexual harassment’ across all the relevant components of the system ; and (g) What was the outcome of that review ?

(a) Yes. Incidents of sexual harassment are reported using the WorkSafe 24/7 telephone line, by email or online and recorded in the Department of Local Government, Industry Regulation and Safety’s WorkSafe group business systems.
(b) In 2024-25, 84 reports of sexual harassment or assault were made to WorkSafe with respect to the mining sector.
In 2023-24, 438 reports of sexual harassment or assault were received from the mining sector. This includes historic’ notified incidents occurring prior to the reporting year.
(c) None. The work health and safety legislation does not require non-disclosure agreements to be notified to the department.
(d) The WorkSafe group has published an information sheet and guide on the use of confidentiality clauses in the resolution of workplace sexual harassment complaints.
(e) The Memorandum of Understanding is undergoing review prior to agreement by the WorkSafe group and the Western Australia Police Force.
(f) The review is in progress with codes of practice, guidance, information sheets and other information being progressively updated to define sexual harassment in accordance with the Sex Discrimination Act 1984 (Cth).
(g) Not applicable.
