I refer to question on notice No. 699, dated 17 August 2000 and answers provided -
(1) Can the Minister explain the rationale as to why a decision was made by the Department of Minerals to pursue the tenement holder on P26/1338 for an alleged breach of tenement conditions and institute forfeiture proceedings?
(2) If not, why not?
(3) Does the Minister consider that the amount of 3150 tonnes of material which had been extracted to be of sufficient gravity to warrant the department instituting or implementing forfeiture proceedings for a breach of tenement conditions?
(4) If so, can the Minister explain the reasons why?
(5) Can the Minister state what area in terms of square metres was affected from the alleged breach?
(6) If not, why not?
(7) Can the Minister explain by what process and the mechanisms under the
Mining Act
or whatever enabled the Department of Minerals and Energy to implement forfeiture proceedings before it appeared in the
Gazette
on July 11 1997?
