WIDENING
23. Hon PETER COLLIER to the minister representing the
Minister for Transport:
I refer to the delays to the Kwinana
Freeway widening project.
(1) What was the date for practical
completion when the contract was first signed?
(2) Are there any liquidated damages
in the contract for failure to complete the project on time?
(3) If yes to
(2), does the state intend to seek liquidated damages, given the project has
been delayed; and, if not, why not?
(4) Are there any
penalty clauses in the contract if the contractor causes major disruptions to
traffic; and, if not, why not?

I thank the Leader of the Opposition
for some notice of the question.
(1) In order to
minimise traffic disruption, early works for the Metronet Thornlie–Cockburn
Link were integrated into the Kwinana
Freeway northbound widening project in December 2019. The staged opening of new northbound freeway lanes is expected between February and April 2020.
This was announced via a media statement on 17 December 2019.
(2) Yes.
(3) Liquidated damages are not applicable to the
extension of time associated with the amended scope in part (1).
(4) There are no penalty clauses.
