I refer to the Harriet Point Agreement between the Pilbara Ports Authority and BHP, and I ask: (a) does the Minister have access to the agreement; (b) has the Minister ever requested access to the agreement; (c) if yes to (b), what was the date of the request, who was the request made to and what was the answer received; (d) is the agreement consistent with S.81 of the Financial Management Act 2006 with respect to the provision of information to Parliament; (e) has the Minister or the Pilbara Ports Authority ever sought agreement from BHP to provide the agreement to Parliament; (f) if yes to (e), on what date was such a request made, to whom was the request made by and to, and what was the answer received; (g) was the agreement executed during the caretaker period in August 2008; (h) if yes to (e), was the agreement executed in accordance with caretaker conventions; and (i) are there any other agreements executed by the Pilbara Ports Authority that are confidential?

(a)-(i) The Minister requested a copy of the agreement from the CEO of the Pilbara Ports Authority in accordance with Section 75 of the Port Authorities Act 1999 on 21 August 2018 for the purposes of informing government decision making regarding strategic and port planning matters. A copy of the agreement was provided in compliance with this request on 23 August 2018. The agreement was not executed during the caretaker period in August 2008.
