I refer to the minister’s answers to parts (4) and (5) of my question without notice 91, asked on Thursday, 7 April 2005, and ask - (1) Is the minister aware that final design proposals for the Port Hedland enhancement scheme will be discussed in Port Hedland over the next few days? (2) Have such plans been submitted to the Environmental Protection Authority? (3) If no to (2), is the minister concerned that the details of the enhancement scheme are still being withheld from the EPA? I thank the member for some notice of this question. (1) Yes. (2) The Environmental Protection Authority has advised the Minister for the Environment that the final plans have not yet been submitted. The EPA is aware that the proponent is seeking to finalise its design over the next few days before referring its proposal. (3) The Minister for the Environment has advised that the plans are not being withheld from the EPA. The proponent is aware of its obligations to refer the proposal to the EPA. Proponents are encouraged to consider and satisfactorily resolve environmental issues that may result from development as part of their planning. (4) The EPA will consider the environmental impacts of the proposal that the proponent refers. When the proposal is referred, the EPA is required to determine whether it is to be assessed, and, if so, at what level in accordance with section 38 of the Environmental Protection Act 1986. The Minister for the Environment has asked the EPA to advise the honourable member of its decision.
