Department of the Premier and Cabinet (1) Yes. (2) The Native Title (State Provisions) Act 1999 , Part 4, Part 5 (Divisions 1, 2 and 3) and Part 6 have not been proclaimed. The Act is not operative because the Federal Parliament did not endorse relevant provisions, as required under the Native Title Act 1993 (Cth). The Civil Liability Amendment Act 2003 (No 58 of 2003), Sections 9 and 14 are not yet proclaimed. These sections deal with proportionate liability. Commonwealth, state and territory Insurance Ministers and Attorneys General are endeavouring to establish a consistent approach to proportionate liability in order to avoid forum shopping and reduce costs of litigation. Further amendments to these yet to be proclaimed provisions may be proposed in order to achieve a consistent approach. Anti-Corruption Commission The Anti-Corruption Commission has provided the following information: (a) Nil. (b) Not applicable. Governor’s Establishment (a) No. (b) Not applicable. Office of the Public Sector Standards Commissioner The Commissioner for Public Sector Standards advises as follows: (a) No. (b) Not applicable.
