Given that order RT/2004-000002 brought down by the Western Australian Retirement Villages Disputes Tribunal in the matter between Norma Parker and Timberside Villas Management Pty Ltd remains binding unless or until overturned by the District Court - (1) Has the Department of Consumer and Employment Protection enforced the Retirement Villages Disputes Tribunal order that the terms of a service contract may not be varied without the consent of the tribunal? (2) If not, why not and how many retirement village service contracts have been varied without the authority of the tribunal? Hon JON FORD
