(2) The text of the Conservation and Land Management Amendment Act 1991, including sections 51 and 57 (items 1, 2 and 6 of the Schedule), is provided in the “Acts of the Parliament of Western Australia passed in the year 1991 during the 3rd session of the 33rd Parliament” published by the authority of the Government Printer. The unproclaimed amendments, which would have established a body to be known as the Nature Conservation Trust of Western Australia, were adversely affected by subsequent changes to the Commonwealth taxation law. The Trust to be created was regarded by the Commonwealth Taxation Commissioner as not being independent in so far as its income was effectively to be directed to support the interests of its controller, the Minister for the Environment, and it could be considered to be a conduit for the donations of money to the State Government. While the objectives of the proposed Trust were laudable, the inability to obtain tax deductibility for donations would have resulted in an ineffectual fund raising capacity.
