I understand the matter referred to is that of Adbooth Pty Ltd and the City of Perth ([2007] WASAT 76), decided by the State Administrative Tribunal (SAT) on 2 April 2007.
I am advised that an application for leave to appeal SAT's decision to the Supreme Court is to be heard on 29 August 2007.
Accordingly, while I recognise the importance of this issue, it is premature for me to make any statement concerning the wider applicability of the decision and whether the decision might lead to any changes in relevant State policies or legislation, including subsidiary legislation such as the "Model Scheme Text". I note also that Telstra is a telecommunications carrier - as are Vodafone and Optus - for purposes of the (Cth)
Telecommunications Act 1997
, and the Federal Minister for Telecommunications has responsibility for the administration of that Act.
I have asked the Department for Planning and Infrastructure to monitor this matter and keep me informed.
