and other media outlets on Friday, 4 May 2012 in which the Premier is quoted as saying 'The decision as to where the gas goes lies with the West Australian Government because of the [State] Agreement Acts that cover both James Price Point and the North West Shelf project', I ask —
(1) To which Agreement Acts is the Premier referring and are each of these Agreement Acts enacted?
(2) If yes to (1), will the Premier table the Agreement Acts?
(3) If no to (1), when does the Premier intend to have such a Bill presented to Parliament?
(4) Upon which Acts of Western Australia does the Premier intend to rely in order to compel development at James Price Point?
(5) Was the Premier correct in claiming that an Agreement Act covers James Price Point?
(6) If no to (5), will the Premier correct this statement on the record?

(1-6) The North West Gas Development (Woodside) Agreement Act 1979 provides the basis on which gas can be processed at the North West Shelf gas plant subject to the Government's agreement to proposals submitted by the Joint Venture parties. The Act is available from the State Law Publisher.
The Browse (Land) Agreement commits the State to limiting gas processing facilities along the Kimberley Coastline to within the Browse LNG Precinct. The State intends to introduce a Bill to ratify this Agreement as an Act of Parliament. The Browse (Land) Agreement is accessible on the Department of State Development's website - www.dsd.wa.gov.au/BrowseLNG.
Government will negotiate State Agreements with proponents seeking to develop major facilities in Western Australia, where appropriate, in order to implement Government policy. Government will introduce such Bills into Parliament once agreement has been reached between the parties.
