I refer to a letter dated July 7 1999 from Hon Norman Moore, Minister for Mines addressed to Mr Brian Hounslow reference 91287, 92331, 92739 and 93195 and activities, which I understand, have been taking place in October/November 2001 where various equipment has been stored some within sheds allegedly in breach of section 20(5) of the
Mining Act
within 100 metres of 7 Williamstown Road near the Cassidy/Mt Charlotte headframe -
(1) Will the Minister urgently instruct or encourage his department with an inspector to immediately contact Mr Hounslow so he can clearly point out where various equipment has been stored, while the inspector can also collect photographic and possibly other evidence given the Minister has previously stated ‘With Regard to the Proximity of the mining operation, legal advice provided by the Crown Solicitors office confirms that the 100 metre zone referred to in section 20(5) of the
Mining Act
applies in relation to your property. As a consequence KCGM, as the holder of Mining Lease 26/353 over the area must comply with section 20(5)’?
(2) If not, why not?
(3) Will the Minister ensure that under no circumstances is KCGM to be pre-warned or notified in any way that an inspector is coming or going to their Mt Charlotte/Cassidy shaft mining operations so as the company does not have the ability to remove any clear evidence of equipment which has been stored within 100 metres of Mr Hounslow’s residence given this has previously happened in the past?
(4) If not, why not?

(1-2) The Regional Mining Engineer and the Regional Mining Registrar have already interviewed Mr Hounslow on the 5 and 6 March 2002 concerning his complaint of 15 February 2002. (3-4) I have been informed by the Department that the inspector who visited Mt Charlotte on 9 March 2002 to conduct an inspection contacted the Mine Manager in advance in order to gain access due to the mine having shut down and the site being secured.
