I refer to a file note which I understand is dated August 27 1999 addressed to the Minister signed by L C Ranford Director General titled ‘Waste Control Pty Ltd Bulbey Street, Bellevue’ -
(1) Is it correct that part of this file note states ‘The explosives and dangerous goods division has been concerned about this site for some time and has given it special consideration due to its environment- serving function within the community. It is important to note that under different circumstances the division would have prosecuted or closed down the premises due to non- compliances with dangerous goods regulations. This stance was based upon Waste Control being active and willing to progress a program of upgrading. This progress has not occurred following visits by Inspectors from the division dating back to 1993, and a decision has now been taken to bring this matter to a conclusion’?
(2) If no to (1), will the Minister table the file note?
(3) Can the Minister explain what specific ‘special consideration’ was given to this site by the department?
(4) If no to (3), why not?
(5) Can the Minister state what were the specific factual circumstances that the department had as reasons to not prosecute or close down the premises due to non compliances with dangerous goods regulations?
(6) If no to (5), why not?
(7) Can the Minister state why under different circumstances the division or the department would have prosecuted or closed down the premises due to non compliances with dangerous goods regulations?
(8) If no to (7), why not?
(9) Can the Minister state how many breaches of regulations and Acts, the specific nature of each breach and the potential penalty as a consequence of each breach that occurred from 1993 through to August 1999 at the Waste Control Bellevue site?
(10) If no to (9), why not?
(11) Can the Minister state why departmental inspectors did not in the first instance when breaches of dangerous goods regulations were repeatedly being identified at the site take proactive decisive action and close the premises/company down?
