I refer to the report of the Community Development and Justice Standing Committee’s Report on the Inquiry into Fire and Emergency Services Legislation (Report No. 3), 2006
and, in particular, to recommendation no. 3 which provided that the consultation process, drafting process and resulting legislation was to recognise and provide for the unique and individual requirements of each emergency service. I therefore ask:
(a) is it anticipated that new legislation will be drafted in accordance with the Inquiry’s recommendations;
(b) at what stage is the drafting;
(c) has the consultation process commenced:
(i) if not, why not;
(ii) if yes, what parties have been consulted to date; and
(d) are there other stakeholders not yet consulted but who the Minister anticipates being consulted prior to the finalisation of drafting or introduction of new legislation?

Since Cabinet endorsement of the recommendations including the drafting of the new legislation in November 2008, the Fire and Emergency Services Authority of Western Australia (FESA) advises:
(a) Yes
(b) FESA has appointed a Project Officer responsible for progressing the legislative amendments. The legislation will be progressed in two stages. The first stage will address the critical amendments and the second stage will comprise the longer term development of one Emergency Services Act for Western Australia.
(c) Yes
(i) Not applicable
(ii) Consultation has been undertaken with the following:
- WA Local Government Association;
- Fire and Emergency Services Superannuation Fund;
- Volunteer Fire and Rescue Services Consultative Committee;
- Bush Fire Service Consultative Committee;
- State Emergency Service Consultative Committee;
- Volunteer Marine Rescue Services Consultative Committee;
- Association of Volunteer Bush Fire Brigades of WA (Inc.);
- Volunteer Marine Rescue Association Western Australia;
- WA Volunteer Fire and Rescue Services Association (Inc.);
- WA Volunteer SES Association (Inc.);
- Emergency Service Volunteers Association of Western Australia;
- Department of Environment and Conservation;
- Department of Treasury and Finance;
- Department of Commerce; and

- United Firefighters Union;
- Pastoralist and Graziers Association;
