The issue relates to future land use options for the site and the Government is dealing with this matter because of the complete failure of the previous Government, who failed miserably in the area of community consultation for future use options for the site. The Government gave a commitment whilst in Opposition that it would develop and implement a fully interactive community consultation process that would seek a consensus view on the future uses of the site and we have honoured that commitment. This process went for a number of months and involved dicsussion with various Government Department's, community representatives and local government. The Minister has also referred some matters to me that come within the planning portfolio aread. In particular, I have dealt with Town Planning Scheme amendment No 356 to the City of Swan's Town Planning Scheme No 9. This amendment proposes to rezone land near Ellenbrook road, Bullsbrook, from General Road to Special Purpose. The land adjoins a habitat of the Western Swamp Tortoise and the amendment raises environmental issues. The amendment was originally advertised in late 1999 and a recommendation concerning the amendment made to the former Minister for Planning by the Western Australian Planning Commission in July 2000. Section 44A of that Act applies to Parliamentary Secretaries. Subsection (1) of Section 44A says: The Governor in Council may- (a) appoint a person who is a member for the Legislature to be the Parliamentary Secretary to a Minister, that is to the holder of a principal executive office referred to in section 43; and (b) At any time revoke such an appointment. Subsection (2) goes on to say: "An office of Parliamenary Secretary under this section is not one to which section 43 applies but is liable to be vacated on political grounds in the same manner as a principal executive office referred to in that section. The other relevant part of that section is at (3), which reads "The functions of a Parliamentary Secretary appointed under this section are such as the Governor in Council may specify in the instrument of appointment." On 26 March 2001 I was advised by the Premier that the Governor in Excutive Council had approved my appointment as Parliamentary Secretary to the Minister for Planning and Infrastrcuture and to the Minister for Education;Sport and Recreation;Indigeous Affairs, with effect on and from 20 March 2001. I understand that my functions as Parliamentary Secretary are, in broad terms: To have the carriage of Government Bills in the Legislative Council. This has so far included the Railway (Narngulu to Geraldton) Bill, the Armadale Redevelopment Bill and currently includes the Planning Appeals Amendment Bill and the Transfer of Land Amendment Bill; To assist with the parliamentary business of the Ministers and to assist with other parliamentary business as required by the Leader of the Government in the Legislative Council, which has on a number of occasions included Urgency Motions; To assist in the performance of official duties with respect to the Minister' portfolios as required by the Minister or the Premier; To be open to questions in the Parliament on legisaltion of which I have charge; and To do things that are incidental to these functions. I am aware my authority as Parliamentary Secretary is restricted in the following ways: I must not take any direct responsibility for the administration of the Government such as would normally be assumed by the Minister; I may not be charged with the executive adminstration of Acts.
