CRIMINAL CODE AMENDMENT ACT 2009 — REVIEW
959. Hon ALISON XAMON to the Attorney General:
I refer to the review of the operation and effectiveness of
the amendments made to the Criminal Code by the Criminal Code Amendment Act
2009.
(1) Has the review commenced?
(2) If no to (1), why not?
(3) Who is conducting the review?
(4) Which individuals, agencies or organisations will be
consulted during the review?
(5) When is it expected that the review report will be
finalised and tabled in Parliament?

I provide this response on behalf of the Attorney General.
(1) Under
section 740A(1) of the Western Australian Criminal Code, the statutory review
is stipulated to commence as soon as practicable after 3 December 2012. Even
so, the government has commenced planning for the review.
(2) Not applicable.
(3) The Department of the Attorney General is conducting the
review.
(4) The scope of consultation is under consideration.
(5) The report
is expected to be finalised by mid-2013. The report will be tabled in
Parliament following consideration by government as soon as is practicable
after that date.
