I refer to the contractual compliance and monitoring framework for registered training organisations (RTO), and I ask: (a) of the 27 RTO found to be non-compliant in 2013-14, how many were investigated and sanctioned; (b) what examples of non-compliance were identified; (c) what percentage of RTO operating in Western Australia are audited each year; (d) how many new training providers were registered in 2012-13, 2013-14 and 2014 to date; and (e) what actions are taken to identify and monitor people and companies offering training which are not registered?

(a) The Department of Training and Workforce Development has conducted 12 follow up contractual audits to date consisting of system, remote and on-site audits. In all instances but one, satisfactory rectifications were undertaken by the RTOs. The one RTO that failed to satisfactorily rectify the identified non-compliances was not recontracted in 2014.
(b) The most common contractual non-compliances identified was the incorrect application of student fees and charges under the purchasing agreement. Other non-compliances included poor record keeping for reported funded activity, and websites and marketing material where insufficient or inaccurate information was published by the RTO in relation to Department funded courses.
(c) The percentage of contractual audits conducted by the Department under the contractual compliance and monitoring framework is:
· in 2013, 15% of the contracted providers; and
· in 2014 as at 31 October 2014, 40% of the contracted providers.
(d) Under the Western Australian Training Accreditation Council's registration arrangements:
· 23 new training providers were registered in 2012-13;
· 30 new training providers were registered in 2013-14; and
· 5 new training providers were registered from 1 July 2014 to 31 October 2014.
Under the Australian Skills Quality Authority registration arrangements, nationally registered training organisations that deliver training in Western Australia:
· 185 new training providers were registered in 2012-13;
· 286 new training providers were registered in 2013-14; and
· 60 new training providers were registered from 1 July 2014 to 30 September 2014.
(e) No action is taken to identify and monitor people and companies offering training which are not registered. This is outside the Training Accreditation Council's and the Australian Skills Quality Authority's jurisdiction. Only Registered Training Organisations are regulated by the Training Accreditation Council or the Australian Skills Quality Authority.
