I refer to the WasteStream Waste Dump Facility on Ratcliffe Road Kwinana, and ask:
(a) what is the length of the lease for the facility;
(b) what are the environmental conditions relevant to this project;
(c) what is the height restrictions for infill at the waste site; and
(d) what remediation obligations have been placed on the operators of the facility?

(a) The Department of Environment and Conservation (DEC) does not lease the premises comprising part Lot 304 on Diagram 72808 and Lot 434 on plan 220492. Lot 304 is owned by the Western Australian Planning Commission and any questions relating to the lease of this lot should be referred to the Minister for Planning. Any questions relating to the lease of Lot 434, Crown Reserve 26572, should be referred to the Minister for Lands.
(b) The premises is licensed under Section 56 of the
Environmental Protection Act 1986
(Licence Number L6772/1997/11). There are 30 conditions attached to this licence. [see tabled paper no]
(c) DEC understands that the Western Australian Planning Commission has set the height restrictions to 62 metres Australian Height Datum.
(d) DEC is not aware of any remediation requirements under the site's current planning approvals. The current licence for the facility expires on 24 July 2012. DEC is not able to attach conditions to a licence that require performance beyond the term of the licence. However conditions 28 to 30 of the current licence require the provision of an Environmental Improvement Plan by 30 June 2012.
