I refer to the proposed development at Lot 50 in Exmouth, with the proponents being Exmouth Limestone Pty Ltd (the lessee) and Ezion Holdings, a wholly owned and based Singapore company, the developer and lessor, and I ask -
(1) Is it true that Ezion will begin building a marine supply base in Exmouth within the next two months?
(2) If no to (1), what is the time frame for the commencement of the building of a supply base in Exmouth?
(3) Has the Environmental Protection Authority (EPA) approval been granted for the project?
(4) If yes to (3), when was application first made and approval granted?
(5) Has EPA approval ever been extended for this project?
(6) If yes to (5), -
(a) when; and
(b) for how long?
(7) When was the application made to EPA to have the approval extended, and who was the applicant?
(8) Has there been a review of the environmental conditions for this project?
(9) If yes to (8), what changes were made to the conditions?
(10) Will the Minister table the revised environment conditions?
(11) If no to (10), why not?
(12) When was Development Approval first granted for the project?
(13) Has Development Approval expired for the project at any time?
(14) If yes to (13), when?
(15) Has an extension of the Development Approval expired for the project at any time?
(16) If yes to (15), when?
(17) Who made application for an extension of Development Approval and if granted, -
(a) when was it granted; and
(b) for how long?
(18) Given that the proposed use of the jetty has changed significantly from limestone-rock load out for Exmouth Limestone Pty Ltd to that of a marine supply base, why has there been no further full environmental review of the proposed development?

(1-4)  Exmouth Limestone Pty Ltd holds an approval for a Barge Loading Facility at Exmouth for its products (Ministerial statement 465 dated 19 January 1998). There is currently no formal proposal before the EPA to amend this approval.
(5-7)  Following an audit of the site in 2000 onshore components of the barge loading facility had been constructed indicating the proposal had substantially commenced. On the basis that works had begun within five years of the date of Ministerial statement 465, the approval remains valid.
(8-11) Environmental conditions have not been reviewed for this project. However, the Office of the Environmental Protection Authority is currently conducting an audit of compliance with conditions of Ministerial statement 465.
(12-17) This question should be addressed to the Minister for Planning or the relevant local government jurisdiction.
(18) On 9 February 2011 the Chairman of the EPA wrote to Ezion Holdings Limited and to Exmouth Limestone Pty Ltd indicating that if the intention is to develop a facility that is different to that approved in Ministerial statement 465, then the proposal should be referred to the EPA for consideration.
To date, the Environmental Protection Authority has not received a formal request to change Statement 465, nor has any new proposal been referred to the authority.
