I refer to the donation of St Emilie's convent, Kalamunda by the government to Esther foundation in December 2010 and ask: (a) what activity is currently being undertaken at those premises; (b) were there any conditions or contractual terms which required the use of that building for specific purposes and within a certain time frame; and (c) if yes to (b), what are the consequences of failure to comply with any such condition or term of the contract?

The Department of Housing advises:
(a)
A detailed scope of works for the refurbishment of the premises is near completion.
Day to day care, maintenance and security of the premises is undertaken.
(b)
Yes
(c)
In an instance where there is a breach of the agreement, the Department can serve a
breach notice on the Esther Foundation. Should this not be complied with, the Department can elect to terminate the agreement and repossess the property.
