(a) is it the current government’s policy to refuse an application for extended trading if the proposal is not supported by the majority of local community members, as stipulated under clause 4;
(b) is it the current government’s policy to refuse an application for extended trading hours if the proposal is not supported by the majority of retailers, as stipulated under clause 4;
(c) for the purposes of clause 4, which of the following are deemed to be “local members of State Parliament” in relation to the City of Bunbury:
(i) the three MLAs whose Districts cover the City of Bunbury (Bunbury, Leschenault and Capel); or
(ii) the one MLC who maintains an office within the City of Bunbury; or
(iii) the remaining MLCs for the South West Region who do not maintain offices in the City of Bunbury?
(d) is it government policy that all local trader organisations must support an extended trading hours proposal before it will be approved;
(e) is it government policy that:
(i) all; or
(ii) a majority of local members of State Parliament
must support an extended trading hours proposal before it will be approved;
(f) has the current State Government approved permanent/long term extended trading hours for a non metropolitan area in the absence of support from the majority of local community members;
(g) has the current State Government approved permanent/long term extended trading hours for a non-metropolitan area in the absence of support from the majority of local retailers;
(h) has the current State Government approved permanent/long term extended trading hours for a non-metropolitan area in the absence of support from the majority of local members of State Parliament; and
(i) has the current State Government approved permanent/long term extended trading hours for a non metropolitan area in the absence of support from the majority of local trader organisations?

(a) The policy requires applicant Local Governments to confirm that their extended trading proposal is supported by the majority of local community members and retailers. Applications which fail to demonstrate majority local community and retailer support will not be approved.
(b) Yes.
(c) The terms of consultation with local MLA's and MLC's are not prescribed as different issues emerge with each application. It is the responsibility of the applicant Local Government to consult with local members of State Parliament they consider relevant to the proposal, and take the views expressed by those consulted, into account. I will then consider and evaluate the outcomes of that process and determine each application on its merits.
(d) No. The guidelines refer to a majority of traders supporting extended hours.
(e)(i-ii) No.
(f)-(i) No.
