DEPARTMENT OF EDUCATION — MISCONDUCT

1442. Hon SUE ELLERY to the Minister for
Education:

each of the most common categories of misconduct allegations—physical
assault, inappropriate behaviour, fraud and/or theft, and verbal abuse —
(1) What is the
average time taken to resolve allegations?
(2) What is the
longest time taken to resolve allegations?
(3) What is the
shortest time taken to resolve allegations?

I thank the honourable member for
some notice of the question.
(1) It is 159
days for physical assault, 151 days for inappropriate behaviour, 171 days for
fraud and/or theft, and 201 days for verbal abuse.
(2) It is 817
days for physical assault, 950 days for inappropriate behaviour, 571 days for
fraud and/or theft, and 227 days for verbal abuse.
(3) It is eight
days for physical assault, one day for inappropriate behaviour, one day for
fraud and/or theft, and 176 days for verbal abuse. In the last category, there
were only two allegations, both of which formed part of a broader
investigation; hence the extended time frames. The time frame to resolve an
allegation is influenced by matters such as multiple allegations arising from
an event or events; police involvement and/or medical evidence regarding a
respondent's fitness to participate in disciplinary investigations; the
availability of witnesses; and the procedural fairness time frames embedded
within the investigative process.
The above information relates to the
number of allegations resolved in the 2014–15 financial year, which may
have been received in previous years. These figures include allegations that
were managed at both the central and local levels.
