MEMBER FOR BALLAJURA - DRIVER’S LICENCE
I refer the Attorney General to question without notice 678. (1) Was it by error that the letter from the Crown Solicitor’s Office to Mr D’Orazio’s lawyer was tabled in reply to the question instead of the legal advice provided to the Fines Enforcement Registry? (2) If so, will the Attorney General table the legal advice provided to the Fines Enforcement Registry that was mentioned in the tabled letter; and, if not, why not? (3) If the advice is not tabled, will the Attorney General indicate which specific acts and regulations, if any, were relied upon for the conclusion drawn in the legal advice provided to the registry? Hon SUE ELLERY

I thank the honourable member for some notice of the question. (1) No. As stated in the response to question without notice 678 on 31 August, the correspondence forwarded to the member for Ballajura’s lawyer on 29 June 2006 was tabled to ensure clarity in relation to the proceedings in the Supreme Court. (2) Legal advice provided to the Fines Enforcement Registry is subject to legal professional privilege. (3) See answer to (2) Hon NORMAN MOORE : I know the parliamentary secretary is not responsible for the content of the answers she provides, but she is responsible for providing them. She did not answer the third part of that question. Will the parliamentary secretary have another look at it at some time? Hon Sue Ellery : I will raise what you said with the Attorney General.
