I refer to the final KCGM Seepage and Groundwater Management Plan dated September 29 2005, and the Department of Environment (DoE) file note titled ‘Note on Reissue of Licence 6420’ dated September 29 2005, and a letter dated August 24 2005, from Mr L Mills addressed to the Chief Executive Officer, Department of Environment making comments about the draft seepage and groundwater management plan dated July 22 2005 -
(1) Can the Minister state the specific dates that the letter dated August 24 2005 above was first received by fax and subsequently in the mail by the Department?
(2) If no to (1), why not?
(3) Can the Minister explain why the Department ignored part of that letter which stated ‘When KCGM has produced what they regard as the final seepage and groundwater Management Plan and before the DoE approves it, I am requesting that it is provided to me to comment on and have any discussions with the Department?
(4) If no to (3), why not?
(5) Can the Minister explain why all of the issues raised in this letter dated August 24 2005, are not documented in the file note titled ‘Note on Reissue of licence 6420 dated September 29 2005’?

(3) A copy of the draft Seepage and Groundwater Management Plan was provided to Mr Mills and no comments were received. KCGM advertised the draft Seepage and Groundwater Management Plan on 23 July 2005 with an initial closing date for submissions of 12 August 2005. Following requests from the community the comment period was extended to 24 August 2005. The DoE considers that KCGM provided a reasonable time for the public to provide comments on the draft plan. The DoE did not consider it appropriate that another public comment period be provided for the document as no comments were received within the initial comment period. (4) Not applicable. (5) The DoE did not consider that the letter was a submission on the issue of licence 6420. It is worth noting that the Note on Reissue did summarise that meetings were held with interested parties, but did not provide details on those parties, to ensure the identity of those parties was not divulged and their comments could be considered in confidence.
