The previous Minister for Planning stated that a land grant to Port Kennedy Resorts was to be based on public works carried out, including the dual use paths along Port Kennedy Drive -
(1) Can the Minister confirm that this work was carried out as planned?
(2) If yes, who provided the funding for these works including the dual use paths?
(3) If the work was not carried out as planned -
(a) did the previous Minister mislead the Parliament;
(b) was an offence committed by the developers; and
(c) why did the Department of Planning not confirm the work was carried out before granting further land to the developer?

Notwithstanding, I am advised that the previous Minister for Planning approved the last Crown grant to Port Kennedy Resorts Pty Ltd on 19 August 1999, pursuant to clause 10 of the Port Kennedy Development Project Agreement. That approval provided for the granting of $1.515 million worth of Crown Land to Port Kennedy Resorts, which amounted to less than half of the company's claimed entitlement of $3.925 million. I understand that at the time the Minister for Planning was not satisfied that Port Kennedy Resorts Pty Ltd was progressing the Project in accordance with the requirements of the Agreement, and only agreed to the partial release of Crown land on the basis of the company's undertaking that it would use the funds raised from the grants to pay local creditors. I am not aware of any condition imposed at that time relating to the completion of public works. As for the matter of the dual-use paths along Port Kennedy Drive, I can confirm that no Crown grants have been issued for these works, as they have not been completed and, to my knowledge, were not a condition of any Crown grant approval.
