I refer to question without notice C542, asked in the Legislative Council on 5 May 2015, which states that 16 new site applications were assessed as not meeting section 5(b) of the Aboriginal Heritage Act 1972. Will the minister table the names and locations of each of these 16 proposed heritage places? If no to (1), why not? Is there any actual or proposed development taking place at any of these 16 proposed heritage places? No. As a result of the Supreme Court decision on 1 April 2015, those Aboriginal heritage places assessed in relation to section 5(b) of the Aboriginal Heritage Act 1972 will be resubmitted to the Aboriginal Cultural Material Committee for reassessment. However, there is no power under the Aboriginal Heritage Act 1972 to allow for the issue of a stop work or similar order. I am awaiting advice from Department of Aboriginal Affairs and the State Solicitor’s Office on the implications of the Supreme Court decision.
