I refer to the Fimiston I tailings dam owned by Barrick Gold of Australia and Newmont Mining operated by Kalgoorlie Consolidated Gold Mines Pty Ltd (KCGM) and question on notice No. 2585, of September 1 2005 -
(1) In relation to the works approval can the Minister state the reasons why KCGM has been made to comply with their addendum to the notice of intent?
(2) If no to (1), why not?
(3) Can the Minister state the reasons why a condition has not been imposed on the licence reissued on September 30 2005 which requires KCGM to comply with their addendum to the notice of intent?
(4) If no to (3), why not?
(5) Will the Department issue works approvals for any of the three remaining 2.5 metre lifts if the agreed reductions in groundwater levels are not achieved?
(6) If yes to (5), why?
(7) If no to (5), why not?
(8) Can the Minister explain how the Department can refuse to issue works approvals for any of three remaining 2.5 metre lifts under the
Environmental Protection Act 1986

The Addendum to Notice of Intent contains details of how the facility will be constructed. The works approval ensures that the facility is constructed in accordance with this document. (2) Not applicable. (3) Yes. The Addendum to Notice of Intent relates to the construction of the Fimiston I Tailings Storage Facility. Condition G1 of the works approval requires the facility to be constructed in accordance with the Addendum Notice of Intent. The licence relates to the operation of the facility therefore it is not appropriate to place a condition relating to the construction of a Tailings Storage Facility on the licence. (4) Not Applicable.
