I refer to the Department of Conservation and Land Management’s prosecution policy guidelines tabled last week. (1) Which of the factors listed from (a) to (p) were taken into account when the decision was taken to withdraw the illegal land clearing charges against Goundrey Wines Pty Ltd chief Ted Avery? (2) Did Goundrey Wines give a commitment to the Department of Conservation and Land Management prior to the withdrawal of those charges that it would allocate funding to the regeneration of the road verge? In my response last week I referred to the prosecution guidelines of the Director of Public Prosecutions, which are very similar, and identified a couple of the areas dealing with the public interest.
