I refer to the Guildford Hotel, and I ask —
(1) As this historic building deteriorates, does the Minister have any intention to use his powers of compulsory acquisition, under section 73 of the
Heritage of Western Australia Act 1990
, to step in and save the hotel from total ruin?
(2) If yes to (1), what is the point of deterioration that will trigger the acquisition?
(3) If no to (1), why not?

(3) The owners of the Guildford Hotel have put forward a development proposal for the restoration and redevelopment of the property that is consistent with the cultural heritage significance of the place. The development application was formally supported by the State Heritage Office in its statutory advice to the City of Swan.
The owners have development approval for the project subject to conditions from the City of Swan. This is a clear determination on the part of the owners and the City of Swan that the Guildford Hotel is in a condition to effect conservation of its heritage value. Therefore, there is no case for interfering with the owner's right to repair, restore and redevelop their property in a manner that has the support of the Heritage Council and will deliver a vibrant and sustainable mixed-use site with a restored Hotel once again available for community enjoyment.
