I refer to Mining Lease 26/383 owned by Barrick Gold and Newmont Mining, operated by Kalgoorlie Consolidated Gold Mines Pty Ltd, and the Fimiston I tailings dam -
(1) Is it correct that Mining Lease 26/383 has a tenement condition imposed on it which states ‘The walls of the tailings dam being constructed from or having a substantial outer covering of competent waste rock which will prevent long term erosion and when completed the outslopes being contoured such that the maximum angle to the horizontal is 20 degrees’?
(2) If no to (1), will the Minister table a copy of all the tenement conditions on Mining Lease 26/383?
(3) If yes to (1), on what date was this condition imposed on the Mining Lease?
(4) Has the owners/operator breached the tenement condition stated in question (1) given that the tailings dam walls facing Bulong Road and western wall do not have a substantial outer covering of waste rock all the way to the top of the Fimiston I tailings dam in compliance with the tenement condition and similar to how the Fimiston II tailings dam has been constructed?
(5) If no to (4), why not?
(6) Will the Minister/Department immediately issue a stop work order to the owners/operators of the Tailings dam for breaching tenement condition number 23 on Mining Lease 26/383?
(7) If no to (6), why not?
(8) Will the Minister/ Department issue forfeiture proceedings to the owners/operator for breaching tenement condition number 23 on Mining Lease 26/383 and impose the maximum penalty?
(9) If no to (8), why not?
(10) Can the Minister state the rationale as to what was the specific intention when the Department recommended that condition number 23 be imposed on Mining Lease 26/383?
(11) If no (10), why not?
(12) Can the Minister explain why the eastern wall of the tailings dam has waste rock covering the wall all the way to the top of the tailings dam, whereas the western wall and the wall facing Bulong Road do not have competent waste rock all the way to the top of the dam?
(13) If no to (12), why not?
