In reference to previous public ballots for land in South Hedland which preferenced first home buyers and owner occupiers before investors:
(a) has any investigation been undertaken into previous ballots to determine if all those purchasers accepted under the criteria of first home buyer or owner occupier have gone on to occupy the residence;
(b) has any investigation gone into the results of previous ballots to determine if any lots sold under the category of first home buyer or owner occupier are now being used as investment properties; and
(c) since Landgate can only undertake property searches in Western Australia, what mechanisms does the Minister’s Department have in place to ensure that those who enter the ballot under the Department’s definition of first home buyer do not actually own property in other states of Australia?

(a - b) The Department has not undertaken investigations relative to previous ballots however it acknowledges that purchaser's circumstances may change and deals with cases brought to its attention on their individual merits. The Department's intent has been to encourage first homebuyers and owner occupiers and believes this has been achieved in the majority of cases.
(c) The Department, through its Project Manager and Sales Agent, conducts checks for property ownership in Western Australia. It also requires that purchasers complete a Statutory Declaration under the Oaths, Affidavits and Statutory Declarations Act 2005, attesting to their status as a first homebuyer and or owner occupier.
Penalties can be applied for false declarations.
