I refer to the
answer to question without notice C255, asked on 27 May 2025, from which the house
was informed that on-the-spot fines have been issued in relation to the
unlawful sale of nitrous oxide.
(1) Is the minister aware of the online article by
Connor McGoverne on 27 May 2025, entitled, "Buying nangs in Perth is as
easy as ordering UberEats despite tough new laws"?
(2) Is the minister aware that the article reports
that the "Department of Health, which enforces the law, admitted no fines
have been issued"?
(3) How does the minister reconcile her answer and
the information provided to Mr McGoverne?
(4) How many on-the-spot fines have been issued?

been provided by the Minister for Health.
(1)–(4) In late 2024, WA was the first
state in Australia to prohibit the retail sale to the general public of nitrous
oxide canisters through amendments made to the Medicines
and Poisons Regulations 2016 . Two infringement notices totalling $12,000
have been issued by authorised officers of the Department of Health. Compliance
activities are active and ongoing.
