investigated to date; and
(b) what process does BMW
undertake to implement these investigations?
(3) If no to (1) —
(a) why not; and
(b) when will this process be
established?
(4) Does the
state government have any plans to amend the Construction Contracts Act 2004 in
line with issues uncovered by the 2013 ''Final Report: Construction
Subcontractor Investigation''?

AnswerView source ↗

I thank the honourable member for some notice of the
question.
(1) Yes.
(2) (a) Since November
2012, 71 subcontractor non-payment complaints on Building Management and Works
administered projects have been investigated.
(b) Building
Management and Works follows a detailed process to investigate non-payment
complaints and that involves working with subcontractors to understand the
nature of the issue and the extent of the alleged non-payment, and working with
the relevant head contractor to explore and, where possible, resolve the issue.
(3) Not
applicable.
(4) The
Department of Commerce's Building Commission is undertaking a review of
the Construction Contracts Act 2004. The Department of Finance will provide
input on security of payment issues as part of that process.
