(1) At this stage, it is not possible to establish whether increased turbidity, associated with the construction of the seawall, constitutes pollution until current marine studies can be analysed and compared to baseline data collected prior to the commencement of this operation. (2) The Department of Environmental Protection (DEP) and Department of Industry and Resources (DoIR) have visited the site. The licensee, Henry Walker Eltin, has committed to supply data for review by the DEP after the marine study is completed. The DoIR is assessing the appropriateness of construction materials and methods. As a precautionary measure, the seawall construction has been suspended until the DoIR approve entry to the collapsed area of seawall and a suitable minimisation control for the loss of material from the seawall is approved. The DEP will undertake a formal license inspection of the premises in August 2003. The DEP will consider the need to amend the licence where appropriate once the inspection is complete.
