I refer to question on notice No. 2715 of 12 October 2010, from myself to the Minister, and ask -
(1) How many underground mines in Western Australia currently provide dedicated underground toilet facilities?
(2) Are there any requirements for underground toilet facilities to be provided, and what are the criteria for the establishment of these facilities?
(3) If yes to (2), what is the maximum permitted distance that a worker can be located from an underground toilet?
(4) If underground toilet facilities are not provided either by provision of regulation or by company policy, are portable toilet bags required to be provided by the mine operator?
(5) If no to (4), why not?
(6) How many mines currently provide a proprietary product (portable toilet bag) in underground workings?

(1) It is the responsibility of the individual mine to provide toilet facilities and there is no requirement to notify the Department of the number of such facilities.
(2) Mines Safety and Inspection Regulations (1995) Division 2, 7.13 for toilet facilities states:
"
Each responsible person at a mine must ensure that appropriate toilet facilities are provided within a reasonable distance from each workplace at the mine".
(3) There is no "maximum permitted distance" requirement that a worker can be located from an underground toilet in the Mines Safety and Inspection Regulations.
(4) There is no regulatory requirement for the provision of portable toilet bags.
(5) See Answer 4.
(6) There is no regulatory requirement for a mining company to advise the Department of the use of portable toilet bags in underground mines.
