I have given notice of this question. It is long, and I ask members to bear with me. I refer to the appointment to and subsequent resignation of Moira Rayner from the Corruption and Crime Commission. (1) On whose advice did the Premier rely when he decided to appoint Ms Rayner to the commission? (2) On what date did the Premier receive a recommendation from the three members of the nominating committee when selecting his recommendation for Acting Commissioner of the CCC? (3) At the time of making a recommendation referred to in question (1), who were the three members of the nominating committee? (4) Did the Premier seek a recommendation from the three members of the nominating committee when selecting his recommendation for the Commissioner of the CCC? (a) If not, why not? (b) On whose advice did the Premier rely for his recommendation to the Governor for the appointment of the commissioner? (1)-(3) The nominating committee, consisting of the Chief Justice, Chief Judge and community representative Audrey Jackson, advertised for applications for appointment to the position of Acting Commissioner of the Corruption and Crime Commission in The West Australian , The Australian and the Sunday Times on 31 January and 1 February 2004 respectively. The nominating committee’s recommendation to appoint Ms Rayner to the position was received by the Attorney General on approximately 6 May 2004 and by me shortly after. It was referred to the parliamentary Joint Standing Committee on the Corruption and Crime Commission on 17 June 2004. The parliamentary committee consisted of two Liberal MPs and two Labor MPs: Hon Derrick Tomlinson, chair; the member for Perth, deputy chairman; Hon Cheryl Edwardes; and Hon Graham Giffard. The parliamentary committee provided bipartisan support for the appointment on 23 June 2004. I will table my letter to the committee and the subsequent letter from Hon Derrick Tomlinson endorsing Ms Rayner’s appointment. (4)-(6) The appointment of Mr Kevin Hammond as Commissioner of the Corruption and Crime Commission was made in accordance with the provisions of the Corruption and Crime Commission legislation. The Attorney General recommended Mr Hammond’s appointment. The nominating committee had no statutory role in the appointment. (7) Following a request in August 2004 from the commissioner to the Attorney General for an additional acting commissioner of the Corruption and Crime Commission to be appointed, the same nominating committee advertised in The West Australian , The Australian and the Sunday Times on 4 and 5 September 2004 respectively. On 10 November 2004 the nominating committee proposed the names of three people it recommended for the appointment. In April 2005, I consulted the Leader of the Opposition on the appointment, as the parliamentary committee had not yet been established. I then wrote to the parliamentary committee, once established, on 17 June 2005, enclosing a copy of the nominating committee’s report supporting the appointment of Mr Chris Shanahan, SC, and seeking bipartisan support for the appointment. The members of the committee are: the member for Perth, chairman, and the member for Girrawheen, from the Labor Party; and Hon Ray Halligan and Hon Margaret Rowe from the Liberal Party.
