(1) Yes.
(a) The review is being carried out by the Consumer Protection Division of the Department of Commerce.
(2) There has been extensive community consultation since the review of the Act. The review commenced in late 2006 and has included meetings with key stakeholder groups representing the retirement villages industry as well as resident groups.
Consumer Protection initially held a series of 18 public meetings in the latter half of 2006 with more than 900 people across metropolitan and regional areas attending. As a result of these meetings Consumer Protection received almost 200 written submissions. The feedback obtained from the meetings and written submissions was used to identify the issues and prepare an issues paper that underpinned the second phase of consultation.
The issues paper was released in July 2007 and a further 130 written submissions were received. In completing its analysis of those submissions Consumer Protection re-examined a number of issues arising from a report into the Karrinyup Lakes Lifestyle Village which was prepared by the Economics and Industry Standing Committee. The Committee's report also raised new issues which are being taken into account in preparing the final report on the review.
