In relation to the Drug Free Margaret River Pro, which includes the Music Arts Surf Style Festival as promoted in Eventscorp’s 2010 brochure launched by the Minister on 30 January 2010 and referred to in the Minister’s press release of 20 December 2009, I ask:
(a) did Eventscorp’s original tender for a surfing event include a mandatory music or arts festival;
(b) on what date was the successful tender received, on what date did the board endorse the successful tender and on what date did the Minister receive notification and/or endorse the proposal;
(c) did the successful tender include a music/arts festival in their proposal;
(d) what discussions did Eventscorp staff, officials or Tourism Western Australia board members have with the successful tenders or their associates regarding an arts/music festival;
(e) what discussions, meetings, emails, phone calls have Eventscorp staff, officials or Tourism Western Australia board members had with Sunset Events regarding the Music Arts Surf Style (MASS) Festival;
(f) what conflicts of interest were declared by Eventscorp staff, officials or Tourism Western Australia board members regarding the MASS Festival or the Margaret River Pro;
(g) what key performance indicators (KPIs) or attendance figures regarding the MASS Festival are required by Eventscorp as part of the successful tender and acquittal; and
(h) can the Minister table the successful tender document?

(b) The successful tender was received before 11:00am on 7 July 2009. The Tourism Western Australia Board approved funding to the successful tender on 30 November 2009. My Ministerial office was advised on 13 December 2009.
(c) Yes.
(d) A brief conversation was held with the successful tender only to seek clarification about the proposed arts/music festival concept and the type of bands that would be invited to perform.
(e) No communication took place with Sunset Events regarding the MASS Festival.
(f) No conflicts of interest were declared.
(g) Eventscorp only funded the Drug Aware Pro Margaret River surfing event, not the MASS Festival. No KPIs or other measures were developed in relation to the festival.
(h) No. Tourism Western Australia has advised that these documents contain commercial information sensitive to third parties from the public and private sectors . I am advised by Tourism WA that the release of such information would have a significant adverse effect on its business, professional, commercial and financial affairs, as well as those of third parties. Therefore, as a matter of procedural fairness to those third parties, it would be necessary for these documents to be obtained through the Freedom of Information process.
Furthermore, I am advised that Tourism WA is contractually barred from disclosing the tender documents you seek.
