Section 50(d) of the Equal Opportunity Act 1984 provides for specific employment positions within the public sector to be designated for Aboriginal people only. Section 50(d) of the Act recognises Aboriginality as a genuine occupational qualification. It is intended to apply in relation to employment when the person employed is “providing persons of a particular race with services for the purpose of promoting their welfare where those services can most effectively be provided by a person of the same race.”
