I refer to a letter dated October 16 2003 signed by Mr Jim Limerick, Director General Department of Industry and Resources addressed to Mr S. Kean -
(1) Can the Minister state and quote the text of what are the specific ‘other issues’ that Mr Limerick is referring to when he has stated ‘In response to the other issues raised in your letter…’?
(2) If no to (1), why not?
(3) Can the Minister explain why the Director General with the Department of Industry and Resources has negated/avoided its obligations and responsibilities to investigate evidence of current breaches of the
Mining Act 1978
and Regulations given that it is my understanding that Mr S. Kean in a letter dated September 23 2003 clearly stated ‘I wish to make it very clear that I am not just relying on evidence which exists on your departmental files to demonstrate current breaches of the
Mining Act 1978-1987
and Regulations. Referring to my letters dated March 13 2003 and May 6 2003 I am again clearly and deliberately requesting that you send the State Mining Engineer to Kalgoorlie to investigate all of my evidence which includes reports documents, correspondence and onsite visual evidence, not simply departmental evidence supporting current breaches of the legislation which must be viewed in its totality to clearly fully understand.’?
(4) If no to (3), why not?
(5) Can the Minister state why the Director General obscures and attempts to confuse the issues raised by Mr S. Kean while also intentionally being uncooperative when he has stated ‘To date, no new information has been provided regarding specific details of the dangerous and unsafe working conditions that you claim exist’ given that Mr Kean has clearly and deliberately requested that the State Mining Engineer be sent to Kalgoorlie to investigate all of his evidence which includes reports, documents, correspondence and onsite visual evidence, not simply departmental evidence on Department of Industry and Resources files supporting current breaches of the legislation which must be viewed in its totality to clearly fully understand in order for that ‘information’ to be presented to the State Mining in Kalgoorlie with Mr Tony Cooke present?
(6) If no to (5), why not?
