I refer to a media article on 4 June 2011, when the Minister for Transport was quoted as saying that ‘… guidance had been sought from the Public Sector Commission’ in relation to the actions of the former employee of the Esperance Port Authority, and ask -
(1) Has the Minister sought guidance from the Public Sector Commissioner?
(2) What advice has the Public Sector Commissioner provided the Minister with on this matter?
(3) What actions has the Minister taken in regards to the issues raised in this article?
(4) Has any investigation been conducted into the issues referred to in this article?
(5) If yes to (4), what was the outcome of the investigation?
(6) If no to (4), why has this matter not been investigated?
(7) Has any action been taken against any current or former employees of the Esperance Port Authority as a result of the issues raised in the article of 4 June 2011?

(1) Yes
(2 - 3) Following receipt of advice from the Commissioner, the Minister wrote to the Esperance Port Authority seeking clarification and is awaiting further advice from the Port Authority.
(4 - 5) The Esperance Port Authority's newly appointed interim Chief Executive Officer has recently completed a preliminary assessment of a range of matters related to the port.
(6) Not applicable
(7) The appropriate action will be taken upon completion of the Esperance Port Authority's investigation.
